Terms of Service

Thank you for visiting NIN.ART (the "Site"). These Terms of Service (the "Terms") set out the conditions for browsing and using the Site. By using the Site, you ("Users") are deemed to have agreed to these Terms.

Article 1 (Scope)

  1. These Terms apply to all content and services provided by the Site, including articles, artwork images, artist and gallery information, and the glossary.
  2. The Site is a media outlet that shares information about art. It does not sell any products.

Article 2 (Copyright and Intellectual Property)

  1. Copyright and other intellectual property rights in the photographs, artwork images, articles, text, logos, designs and other materials published on the Site (the "Content") belong to the Site, the respective artists, galleries, or other rightful owners.
  2. Photographs and images of artworks on the Site are published with the permission of the artists, galleries, or other rights holders.
  3. Permission to use the Site under these Terms does not transfer or assign any rights in the Content to Users.

Article 3 (Prohibited Acts)

When using the Site, Users must not do any of the following:

  • Copy, repost, distribute, transmit to the public, download, reuse screenshots of, print, modify, or adapt the Content (in particular artwork photographs and images) without the permission of the rights holder
  • Use the Content for commercial purposes
  • Use the Content as training data for machine learning or AI, or as part of any other dataset
  • Damage the honor or reputation of artworks, artists, or other Users, including defamation, slander, or discriminatory expressions
  • Act in violation of laws or public order and morals
  • Interfere with the operation of the Site, including unauthorized access or placing excessive load on it
  • Engage in any other conduct the Site deems inappropriate

Article 4 (Requests and Etiquette)

The Site values respect for artists and their work. You are welcome to share your impressions of artworks and artists, but please refrain from any use that shows no regard for rights holders, such as unauthorized use. When introducing artworks on social media or elsewhere, please credit the artist and the source, and respect the wishes of the rights holder as far as possible.

Article 5 (Quotation and Links)

  1. In principle, you are free to quote the Site within the bounds of proper quotation and to link to it, provided that you do not alter the content and that you clearly state the source.
  2. However, please refrain from linking or embedding in a way that reposts artwork images without the permission of the rights holder.

Article 6 (Disclaimer)

  1. The Site strives to ensure the accuracy, completeness, and usefulness of the information it publishes, but does not guarantee them.
  2. The Site is not liable for any damage arising from the use of, or inability to use, the Site (except where the Site has acted intentionally or with gross negligence).
  3. The Site is not responsible for the content of external sites to which it links.

Article 7 (Changes, Suspension, and Termination of Content and Services)

The Site may change, add, suspend, or terminate its content or services without prior notice to Users.

Article 8 (Changes to These Terms)

The Site may change these Terms without prior notice to Users if it deems it necessary. The revised Terms take effect when they are posted on the Site.

Article 9 (Governing Law)

These Terms are governed by and construed in accordance with the laws of Japan.
